Assumption of Risk and Release of Liability

Who This Applies To

This Assumption of Risk and Release of Liability ("Release") is a legally binding agreement between you and Launch Lab Indoor Golf, LLC, together with its owners, members, managers, employees, contractors, and agents ("Launch Lab", "we", "us"). It applies every time you enter our facility or use our simulator bays, equipment, or premises, whether you booked the session yourself, hold a membership, or are a guest of someone who did.

You agree to this Release by checking the box when you book, create an account, or activate a membership. It forms part of, and is in addition to, our Terms of Service. If the two conflict, this Release controls on the subject of injury, property damage, and liability.

The Nature of the Activity

Golf, including simulator golf, is an active physical activity. Swinging a club and striking a ball indoors carries inherent risks, including but not limited to:

• —Being struck by a club, a ball, or a ball rebounding off the screen, walls, floor, ceiling, enclosure, or other surfaces
• —Strains, sprains, muscle, back, joint, and other bodily injuries from swinging, overexertion, or repetitive motion
• —Slips, trips, and falls, including on hitting mats, turf, steps, and transitions between surfaces
• —Injury caused by the actions or negligence of other guests, including people in your own group
• —Malfunction or failure of simulator equipment, screens, projectors, launch monitors, clubs, furniture, or building systems
• —Pre-existing medical conditions made worse by physical activity, including cardiac events
• —Loss of, theft of, or damage to personal property brought into the facility

Unstaffed Hours and Emergency Protocols

Launch Lab operates 24 hours a day and is frequently unstaffed. Door access is provided by digital unlock technology, and during many or all sessions no Launch Lab employee will be on site. This means no one from Launch Lab will be present to supervise play, enforce safe conduct, inspect equipment immediately prior to your session, or administer first aid or emergency assistance.

You acknowledge and accept the unstaffed nature of the facility. In an emergency, immediately dial 911 first, then notify us at support@launchlabindoorgolf.com.

Duty to Inspect and Report Defects

Because Launch Lab is an unstaffed facility, you agree to visually inspect your assigned simulator bay, hitting mats, enclosures, clubs, and surrounding play area before starting play. If you notice any visible damage, frayed screens, loose turf, equipment malfunction, liquid spills, or hazardous conditions, you agree not to use the damaged equipment or bay and to immediately notify Launch Lab support.

Indemnification and Guest Responsibility

You agree to defend, indemnify, and hold harmless Launch Lab from and against any and all claims, liabilities, losses, damages, expenses, or costs (including reasonable legal fees) arising from or related to: (a) your conduct or use of the facility; (b) your breach of this Release or our Terms of Service; or (c) any claim brought by or on behalf of any guest, minor, or third party you invite, allow, or bring into the facility.

If you bring guests into the facility, you represent that you have informed them of these terms. You remain fully liable for any property damage, unsafe behavior, or injury caused by or involving your guests.

Minors and Parental Indemnification

You must be at least 18 years old to create an account, purchase a membership, or book a session. Guests under the age of 18 ("Minors") are permitted only when continuously supervised by a parent or legal guardian present at all times.

To the maximum extent permitted by Georgia law, if you bring a Minor to Launch Lab, you confirm you are their parent or legal guardian, and you agree to defend, indemnify, and hold harmless Launch Lab from any and all claims, losses, lawsuits, or expenses (including attorney fees) brought by or on behalf of that Minor arising out of or relating to their presence at or use of the facility.

Video Surveillance

For safety, security, and remote management, Launch Lab is monitored by video cameras in common areas, entrances, and simulator bays. Cameras record video only; no audio is recorded, and there are no cameras in restrooms. By entering the premises, you consent to this video monitoring and recording. Recordings may be used for safety reviews and damage attribution, and may be shared with law enforcement or legal counsel as necessary.

Property Damage and Financial Responsibility

You are responsible for any physical damage to Launch Lab property, simulator equipment, screens, launch monitors, cameras, furniture, or building structures resulting from improper use, recklessness, intentional misconduct, or failure to follow facility rules by you or your guests.

Launch Lab may charge the credit card or payment method on file for your account or booking for the actual cost of repairing or replacing any property damaged in this way.

Your Health and Facility Rules

You confirm you are physically able to take part, and that you will consult a physician first if you have any medical condition that physical activity could affect. You agree to follow these facility rules:

• —Check that the swing area and backswing zone are clear before every swing; never swing when anyone is inside the hitting mat area or near the screen
• —Use equipment and clubs only as intended; stop using and report any damaged equipment immediately
• —Do not enter or use the facility while under the influence of drugs or alcohol to a degree that impairs safe play or judgment
• —No firearms, dangerous weapons, open glass containers, or illegal substances are permitted on the premises at any time
• —Comply with all posted rules, bay capacity limits, and instructions provided electronically or in person by Launch Lab

If you sustain an injury or medical emergency, you consent to receive emergency medical treatment and agree that you are solely responsible for all associated financial costs.

Governing Law and Venue

This Release and any dispute arising from it shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflicts of law principles. You agree that any legal action or proceeding shall be filed exclusively in the state or federal courts located in or serving DeKalb County, Georgia, and you submit to the personal jurisdiction of such courts.

If any portion of this Release is held invalid or unenforceable under Georgia law, that provision will be enforced to the maximum extent permitted, and all remaining provisions shall continue in full legal force and effect.
